Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Carded platform, including the mobile application, backend services, and any related software provided by Carded ("we", "us", or "our"). By accessing or using Carded, you agree to be bound by these Terms. If you do not agree, do not use the platform.

1. Description of Service

Carded is a subscription-based ID verification platform designed for venue operators (bars, clubs, festivals, and similar establishments) in Canada. The platform allows authorized venue staff to scan government-issued identification documents to verify age and check internal venue ban lists.

2. Eligibility

You must be at least 18 years of age and legally authorized to operate or work at a licensed venue to use Carded. By registering, you represent that you meet these requirements and that all information you provide is accurate and complete.

Carded has two account types:

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at braeden@carded.to if you suspect unauthorized access.

5. Venue Owner Responsibilities

As a venue owner, you are responsible for:

Carded provides the technology infrastructure only. Venue owners bear full legal responsibility for how that infrastructure is used at their venues.

6. Subscriptions and Payment

Access to Carded requires an active subscription. Subscription fees, billing cycles, and plan details will be presented at the time of sign-up. All fees are in Canadian dollars unless otherwise stated. Subscriptions automatically renew unless cancelled before the renewal date. We reserve the right to change pricing with 30 days' notice.

Failure to pay may result in suspension or termination of your account. No refunds are provided for partial billing periods.

7. Data and Privacy

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Carded, you consent to the data practices described therein.

Carded does not store raw identification document numbers. All document identifiers are cryptographically hashed on a per-venue basis and cannot be reversed or cross-referenced between venues.

8. Intellectual Property

All software, design, trademarks, and content associated with Carded are the exclusive property of Carded and its licensors. You are granted a limited, non-exclusive, non-transferable licence to use the platform solely for the purposes described in these Terms. No other rights are granted.

9. Disclaimers

Carded is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free of security vulnerabilities. ID scanning technology is not infallible — Carded does not guarantee the detection of fraudulent or altered identification documents.

Venue operators remain solely responsible for compliance with applicable liquor licensing laws and for entry decisions made at their venues.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Carded and its affiliates, officers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the platform, including but not limited to loss of revenue, data, or goodwill, even if advised of the possibility of such damages.

Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid to us in the three months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Carded and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the platform, your violation of these Terms, or your violation of any third-party rights.

12. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, non-payment, or any conduct we determine to be harmful to the platform or its users. You may cancel your account at any time by contacting us at braeden@carded.to.

13. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario.

14. Changes to These Terms

We may update these Terms from time to time. We will notify registered users by email at least 14 days before material changes take effect. Continued use of the platform after changes constitute acceptance of the updated Terms.
